    Abstract

    This introductory chapter describes the background to the study on participation in courts and tribunals which forms the basis of this volume. The chapter notes that is a long-established legal principle in England and Wales that people should be able to participate effectively in the court and tribunal proceedings that directly concern them, and briefly outlines some of the contrasting ways in which this principle is expressed in law. It is observed that, despite the significance of participation as a legal principle, it has to date been subject to little critical analysis or empirical investigation. The chapter sets out the broad parameters of the study, which entailed national and international policy analysis along with qualitative empirical research in a range of court and tribunal settings, with the aims of examining what participation means, why it matters, and what factors support and impede it.
