    Abstract

    Book synopsis: ‚Prozeduralisierung‘ des Rechts lenkt den Blick weg von materiellen Determinierungen durch Recht hin zur Reflexion über die Verfahren und Prozesse der Normerzeugung. In Abkehr vom regulativen Paradigma eines Wohlfahrts- und Interventionsstaates versprach Prozeduralisierung in der Debatte der 1980er und 1990er Jahre adäquate Verfahren und Beurteilungsmaßstäbe zu generieren, die auch unter den Bedingungen polyzentrischer Rechtserzeugung die Legitimität des Rechts sichern können. Was aber besagt und leistet Prozeduralisierung heute? Die vielgestaltigen Ausprägungen dieses Konzepts werden im vorliegenden Band aus der Perspektive der Philosophie, der Rechtstheorie, der Soziologie und der Politischen Theorie beleuchtet. Die Beiträge wenden sich zum einen den Urszenen und der Evolution der prozeduralen Elemente des Rechts zu. Zum anderen wird über die Aktualität von Prozeduralisierung entlang einzelner Problemfelder – der Konstitutionalisierung, Demokratie und Multinormativität – nachgedacht. Dabei steht auch das Rationalitäts- und Gerechtigkeitsversprechen der Prozeduralisierung auf dem Prüfstand.

In a departure from the regulatory paradigm of a welfare and interventionist state, proceduralization in the debate of the 1980s and 1990s promised to create adequate procedures and assessment criteria which could also ensure the legitimacy of the law under the conditions of polycentric law making. But what does proceduralization mean today? The various forms of this concept are illustrated in this volume from the perspective of philosophy, law theory, sociology and political theory. On the one hand, the contributions address the original and the evolution of the procedural elements of law. On the other hand, the actuality of proceduralisation along individual problem areas - constitutionalization, democracy and multinormativity - is being considered. At the same time, the rationality and righteousness of the procedure is also put to the test.
