Cooper, Penelope and Backen, P. and Marchant, R. (2015) Getting to grips with ground rules hearings: a checklist for judges, advocates and intermediaries to promote the fair treatment of vulnerable people in court. Criminal Law Review 6 , pp. 420-435. ISSN 0011-135X.
Abstract
Examines the development of legal practice surrounding ground rules hearings (GRHs). Discusses when a GRH should take place, the evolution of such rules, their practical application, the role of intermediaries, and the use of ground rules to address restrictions on cross-examining vulnerable witnesses. Analyses a GRH case study to illustrate the problems which may still occur, and presents a checklist for best practice when conducting GRHs.
