Abstract

Contests assertions made by Austin Lovegrove in his article, "The Sentencing Council, the public's sense of justice and personal mitigation", Crim. L.R. 2010, 12, 906-923, in relation to the role played by personal mitigation under the sentencing guidelines currently in force. Argues that the research study on which Lovegrove based his inferences about public attitudes to mitigation contains methodological weaknesses and corrects misperceptions by Lovegrove as to the role of mitigation under the guidelines.
